| The Houston DWI Vacation |

| I never think of Houston, Texas as a vacation spot like Miami, Orlando, or Los Angeles, but this summer I have seen an increase in people getting arrested for DWI in Houston while vacationing. The trouble with this happening apart from the obvious is that the Harris County, Texas courts do not accommodate someone that lives outside the state. In other words, the person must make all of their court appearances. The first court setting after a DWI arrest in Harris County, Texas is a week later. Most people do not vacation that long and need to return home. Their case will not be transferred to their home state. In fact, they will be required to return to Houston, Texas for every court setting. This becomes an expensive proposition. Also, any license suspensions that occur in Texas will follow them to the state where they reside. Lastly, they may face additional consequences in their state for any DWI conviction that may occur in Texas. |

| The first setting dismissal in Harris County, Texas |

| Today, I was fortunate to defend a case where the police report mirrored what my client said to me in our first interview. I must admit that this is not typical. What happens more often is that the police report is an embellishment of the events and puts my client in the worst possible light. Thus, my client is the one that gets charged with the crime. In the case that I handled today, the charges should not have been presented to the Harris District Attorney's Office and the prosecutor reviewing the case should not have accepted the charges despite the case being presented to them by the police officer. While I was able rectify the mistakes made by the police officer and the prosecutor it came to a lot of expense to my client. The client was fortunate to have a reasonable prosecutor be able to review the police report and make the correct the decision to dismiss the case without further investigation. |

| Mug shots tell nothing about the accused |

| Since I DVR all my favorite episodes I rarely watch live television and try my best to watch commercials when I do. Today, I was watching live television and heard a news story stating that they will reveal what mug shots tell about the celebrities that were arrested. In my 15 years of being a criminal defense attorney I have not found a mug shot to show anything about a person that is accused of a crime. Most commonly mug shots are showed by the prosecutors in DWI trials. The most they illustrate is that the person is embarrassed, tired and humiliated. The last thing they want to be is smiling for a mug shot. On the other hand, if they are smiling the prosecutor would be able to use that against them by stating that they accused did not care that they were being arrested of that they were so intoxicated that they did not know that they were being taken into custody for drunk driving. |

| One of the most frustrating emails I get is when a person writes a long email, but never asks a question. Today, I received one from avvo.com, an internet site that is intended to help the public with legal issues and finding an attorney. In the past, I have provided information as a criminal defense attorney on that site on various criminal law issues so I still get contacted by people seeking my advice. The person took the time to write the email, but forgot to tell me some pertinent information like the city where the alleged crime occurred, what police agency arrested him, what criminal court was the case assigned to or even if the case is still pending. Most importantly, the email did not contain a question that I could answer, even if I could. If you are considering sending me an email please include the city, state, and county where the arrest occurred. I unable to answer a legal question if it is outside of the State of Texas. Also, please detail the charges against the accused so I can properly discuss the case with you in the future. |

| Lindsay Lohan- How not to act in a Houston Court |

A lot of clients get annoyed when their court case interferes with their working schedule. Most court appearances are scheduled for weekday mornings and take anywhere from one hour to three each time. Also, most criminal court cases take several months to resolve therefore, so can severely impact professional/work obligations.
A perfect example of how to make matters worse for your criminal case is Lindsay Lohan. Ms. Lohan has been her own worse enemy. She has missed court dates, arrived late to court dates she did attend, and she also been rumored to be drinking while on bond. Due to the perceived lack of respect for the court Ms. Lohan will be paying a significantly higher price than she anticipated. Today, she was ordered to be fitted with a SCRAM device, weekly drug testing, daily alcohol classes, and lose out on work opportunities that she had scheduled in Texas.
It is best for a person to understand that while their case is pending there will be some inconveniences, but is best not to have the judge apply extra conditions by not following the court rules since this will in turn make the situation much worse in the long run. |

| How long does it take to bond someone out of jail in Houston, Harris County, Texas? |

Our criminal defense firm regularly gets a phone call from someone that just had a person they know get arrested for a crime asking the above question. As I would do on most subjects if I was not a criminal defense lawyer they turn to the internet for information. Unfortunately, the internet lacks suffiecient information to answer their query. The short answer is that it could take anywhere from 12-48 hours to bond someone out of jail in Houston, Harris County, Texas. The keys seems to be if you are able to make the bond before the person is transferred to the Harris County jail. Most people are arrested and booked in the local city jail. If a bond is made while the person is waiting in this city jail and before they are transferred to the county jail the time waiting in jail is signficantly reduced.

| How did Lindsay Lohan avoid jail |

Party girl, Lindsay Lohan is in criminal hot water again. Apparently, she is not doing very well with her probation. Fortunately, she was notified about her arrest warrant while working in France. I would not expect the court to call one of my clients to inform them they are about to get arrested. Perhaps, this is done in California, but it is not done in Harris County, Texas. Once she was made aware of the situation it allowed her family to post a non arrest bond on her behalf, saving her from returning to jail. A non arrest bond allows a person to make a bond without going to jail. If you find that there is a warrant for your arrest contact a bonding company to avoid going to jail. Simply them you wish to make a non arrest bond. I have previously discussed non arrest bonds here.

| Harmon's No DIVERT Policy Allowed |

Judge Bill Harmon, Harris County Criminal Court Judge #2, has been the only judge that does not allow the DIVERT program in his court. I have written before how frustrating this is as a Houston DWI Attorney to tell your client that because of the court their case falls into they are not eligible for a program that would save them thousands of dollars and could potentially lead to the expungment of their DWI case.
Recently, a visiting judge ruled that Judge Harmon has the authority to disallow the DIVERT program in his court. I have a feeling that this is not the last we heard of this issue. I still hold out hope that Judge Harmon will change his mind as the program heads to its one year anniversary. Regardless, the decision is being appealed to a higher court.

| Keep Your Mouth Shut |

Being charged with Murder or worse Capital Murder is a very bad position to find ones self in. You would not be helping yourself or your attorney in your defense if you decide to start talking to the media.
Watching the news last night I saw a news story regarding a man who allegedly shot and murdered his wife who was 7 months pregnant. According to the story the couple had 3 young children.
In response to a question from the media while in custody, the man said something to the effect that the victim had it coming for a while. I am paraphrasing and don't remember the exact quote, but what a terrible thing to say.
If the case is at appears to be, at least as it was reported, there were witnesses and the state will have a strong case. The man is presumed innocent, but the case looks like it will be more about punishment than guilt/innocence.
I'm certain that a statement like that will be used by the state as the defense attempts to offer mitigation evidence if the case reaches the punishment stage. The lesson is simple: keep your mouth shut.

If you are caught driving while intoxicated in Texas you could pay over $20000 according to department of Transportation. | Do I need a SR22 after my first drunk driving arrest in Houston? |

| When people call my office after a DWI arrest they ask the question posted above. The answer is straighforward. Typically, the only reason a person would be required to apply for a SR22 arising out of a DWI or drunk driving arrest in Houston,Texas would be because they are seeking an occupational license. However, a SR22 is not requried in a lot of the cases we handle because a first DWI conviction would not cause a license suspension if jail time is avoided. Furthermore, if we save a person's license at the ALR hearing, where DPS is attempting to suspend your driver's license for providing a breath/blood alcohol sample above .08 or refusing to provide a sample altogether, an occupational license wil not be necessary. Therefore in most instances a SR22 is not necessary after a DWI arrest in Houston. |

| Two NFL players arrested for DWI in two days |

The NFL season may be over, but does not mean that their players do not stop making news. NFL players Will Allen and Byron Westbrook were arrested this weekend in seperate instances. It is a shame when a person is merely arrested and it makes national news. Both of these men are presumed to be innocent.
Mr. Allen was arrested while passing a DWI checkpoint. Luckily, the citizens of Texas and more specificially Houston do not have to deal with these type of unreasaonable stops. I have discussed DWI checkpoints before on my journal. If you would like to see what I wrote last year click here concerning checkpoints and what the Texas legislature had in mind.
The Westbrook family is having a difficult week. Byron Westbrook's brother, Brian Westbrook, a NFL running back, was released from his Philadelphia Eagle contract today. I imagine both of these men can not wait for the next season to start since the playing field is where athletes are most able to put away their distractions. |

| Warren Sapp is lucky... |

First of all Warren Sapp is a lucky man in many ways. I remember seeing him play at the University of Miami where he was an all american. Unbelievably, his stock dropped during the NFL draft because of his alleged use of marijuana. Nevertheless, he enjoyed what is considered by many to have had a Hall of Fame career while mainly playing for the Tamba Bucaneers. Currently, he is working for the NFL network.
Unfortunately, this weekend Mr. Sapp was arrested this weekend for domestic battery in Miami Beach, Florida. Mr. Sapp was covering the Super Bowl for the NFL network. While Warren Sapp may feel down right now since he was arrested and will not be covering the Super Bowl for NFL network. The silver lining is that he is presumed to be innocent despite being a celebrity. Lastly, he is lucky that this did not happen in Texas since choking a domestic partner is a felony in our state.

| Charlie Sheen's arrest is typical. |

Sadly, the Sheen household is having a Christmas they would like to forget. Unhappily, this is what commonly happens when there is a domestic violence situation. They arrest the man and ask questions later especially if the man has a prior conviction for this offense. I understand the rush to judgment since for decades this crime went overlooked by law enforcement. Nevertheless, the police are allowing these latent biases tragically affect families. A proper investigaton should still take place without rushing to judgment. I see this happen routinely as a Houston Assault Attorney. The woman is initally seen crying, distraught and frantic. While in this emotional state the woman enhances the story in her favor. Contrastingly, the man acts understated while he tells his story in a muffled tone. The man instinctively thinks this is the way he should act. Unfortunately his remorse is interpreted as a sign of guilt by the police.
These domestic violence situations tend to arise out of a passionate relationship that is unable to properly address a recurring problem. This inablility leads to resentment that causes the violence. Furthermore, the situation is magnified when one or both of them have been driinking. Once it is apparent that the disagreement will not be resolved an uproar ensues and the police are called, Law enforcement should provide better training to the officers responding to these situations so that they are better able to diffuse the scene instead of enflaming it. |

| Anyone can get arrested for DWI... |

| I always tell my clients how easy it is to get arrested for a DWI. The statute does not require that anyone intend to drive while intoxicated like most other crimes. Regularly, we see people that are involved in law enforcement being caught for DWI. Just this weekend an Ohio trooper that has been recognized by M.A.D.D. in the past for the amount of DWI arrests he made was arrested for DWI. One thing that I have noticed as a Houston DWI lawyer is that an officer never provides a breath sample when requested. |

| Joy riding is a felony in Houston |

As a Houston Criminal Defense Lawyer I get parents that can not believe that this is the case. In Texas, joy riding is called unauthorized use of a motor vehicle. This happens a lot when a teenager takes a car without a parent's permission. Unless, the parent comes forward for the child saying that they had persimmon to use the vehicle they will be charged with a felony.
This charge also comes up frequently when someone that is under the influence of drugs or alcohol lends someone the car that they are legally driving in exchange for drugs. The drug induced person later reports the vehicle as stolen to the police. Later, a person that is driving the vehicle is not aware of the report by the owner claiming that it was stolen is pulled over by police and charged with the felony of unauthorized use of a motor vehicle. |

| Here is a crime that I have never seen as a DWI Lawyer...Driving your La-Z-Boy while intoxicated. Somehow a Minnesota man used a lawnmower engine to power his chair down the road, to get into an accident. The man admitted to drinking 8-9 beers. Most disturbing is that this is his second DWI conviction. He was ultimately placed on probation for two years with electronic, but had to forfeit the chair. |

| Oakland Raiders Coach Could Avoid Being Arrested in Houston, Texas |

The Oakland Raiders are known for having some colorful players on their team. During the 70's and 80's they would sign players that wore out their welcome with their teams or were released after having some type of legal issues. Players like Jim Plunkett, Lyle Alzado, and Ted Hendricks fit the Raiders image to a tee.
Lately, the Raiders have fallen from grace. Their team is considered to be one of the worse run franchises in the NFL and owner, Al Davis is routinely mocked by football experts. It has gotten so unruly at "Raider Nation" that during the preseason their coaches were involved in an incident that may lead to assault charges. The Raiders are expecting their head coach, Tom Cable to be arrested for felony assault potentially spending time away from the team during the regular season.
Luckily, in Houston, Texas this can be avoided. In Harris County,Texas there is a procedure to avoid going to jail when there is a warrant for someone's arrest. A "non arrest" bond allows someone to avoid the inconvenience of having to be arrested before going to court to dispute the charges against them. |

| Roman Polanski's recent arrest serves as a reminder |

| In my practice as a Houston Criminal Defense Lawyer a few times a year I have clients that contemplate leaving the United States to avoid their pending charges. Most of the time I convince them that is a bad idea and they stay to fight the case. However, some of my clients that do not follow my advice and leave the country. I can understand that they are scared, confused, and distrustful of the system, but this is hardly ever a good idea. In Texas like most other states the case will not go away despite the amount of time one is out of the country. A perfect example is Roman Polanski, spending over thirty years avoiding an arrest, living life with eyes behind his back, and never able to return to the United States. Mr. Polanski was fortunate that he was able to work abroad, and that additional charges of bail jumping were not filed against him like they would in Houston. I hope that he is treated fairly and not made a poster boy for fleeing the country to avoid prosecution. |

| What is the test that I am going to take for entry into the Harris County, Texas DIVERT program. |

| Now that the Houston, Harris County DWI DIVERT program is in full swing it is important to know the test that you will taking to gain entrance. The test is called SALCE (Substance Abuse/Life Circumstance Evaluation)
A SALCE is a 98-item self-administered questionnaire designed to assess alcohol and drug use/abuse behavior. It results in four measures: Alcohol Use, Drug Use, Test-Taking Attitude, and Life Stress Issues. It also provides treatment recommendations based on individual profiles. The SALCE can be completed in approximately 20–25 minutes, and can be computer-scored.
How one answers these questions will determine if they are allowed to participate in the program or not. If allowed to enter the program it was also dictate what type of supervision a person will need after their DWI arrest.
Keep in mind that if a person is not accepted for the DIVERT program it does not mean that the person is prevented from going to trial on the merits of their DWI case. |

| As a DWI Attorney in Houston we should be more knowlegable about driving while intoxicated cases then the police. That is why I am an expert in the field sobriety tests and I have taken several classes to become more proficient with the machine that the police use to determine a persons breath alcohol level. In keeping with that we are now proude owner of the same machine that the police use in the state of Texas, the intoxilyzer 5000. I can not wait to take part in my next DWI trial after playing with our new toy in the office. |

| Your IPhone may help avoid a DWI arrest |

| As a Houston DWI Lawyer I am always interested in the latest inventions surrounding drunk driving. Recently, Avvo has created an application to be used with the Iphone. The application allows someone to enter the drink they are having into theIPhone while it calculates and estimates the blood alcohol level. The idea is that by having this gadget the person will be more conscience of their alcohol intake before the get behind the wheel of a car. The app also allows someone to quickly search for a DWI Attorney if they are arrested despite drinking responsibly. |

| Wow...could my DWI arrest been any worse? |

| The reality is that in a lot of other states a first time DWI could be a lot worse. As a DWI Attorney that only practices in Texas I know all Texas' DWI laws, but I am aware of the penalties that are imposed in other states. For example, the state of Florida requires a person convicted of their first DWI to immobilize their vehicle for over a month. More harshly, Arizona imposes even more severe penalties for DWI cases. I would hate to be a DWI defendant in a Arizona where in some cases I would be facing a minimum 45 day jail sentence for my first DWI conviction. If you are arrested for a DWI you need an experienced DWI Lawyer that will assist you during this stressful event to make sure that everything is done on your behalf. |

| Did the police officer have to impound my car after my DWI arrest? |

| It goes without saying that everyone gets upset when they are arrested for a DWI. The arresting officer rarely treats the person with respect. Additionally, as a DWI Attorney, I routinely watch the videos where the arrestee makes the request to the police officer to allow someone to come pick up their vehicle before one of the vultures, namely tow truck drivers, take the car to the local impound lot. This is annoying, expensive, and unnecessary. The police officer has the choice to leave the car at a secure location, even to call a friend or family member to come pick up the vehicle before it is impounded. It is callous when the officer knows that someone is available to retrieve the vehicle especially if the arresteee is only a mile or so from their home. Houston police agencies should develop a policy of allowing someone to retrieve the vehicle during a DWI arrest instead of allowing the tow truck drivers, impound lots from profiting. |

| Labor Day 2009- DWI No Refusal Weekend in Houston |

| The Houston Harris County District Attorney's Office once again is making this holiday a "No Refusal" weekend. This seems to be a trend during every holiday. The "No Refusal" weekend actually started on Thursday. This past July 4th set a record for DWI arrests in Houston. Therefore, please be careful when driving in Houston, Texas after having a drink this weekend because if you have read my earlier posts you would not that it is typical that a police officer will arrest you even if you are not legally intoxicated. They seem to think that the law is "Drink, Drive, go to jail" which is completely incorrect. If you have any doubts about your sobriety call someone to help you or just take a cab home to avoid a DWI. |

| Who Gets Arrested For DWI? |

| My clients always share one thing in common...they are always ashamed about their DWI arrest. It does little to tell them that anyone who has a drink in Houston could be arrested. In fact, many respectable people get arrested for DWI. For instance, both President Bush, and Vice President Cheney have been arrested for DWI. How would you like to be the police chief that gets arrested for DWI by his own department? This has happened on several occasions in different cities. Luckily, for most people the worst is behind them after they get arrested for DWI. The case may still get dismissed since they are presumed to be innocent They still have the opportunity to go to trial even if the prosecutor does not dismiss the case. One thing a person does not need to be if they are innocent is ashamed. |

| DWI Arrests In Houston Likely To Increase |

| As a Houston DWI Attorney I have mentioned previously how the upcoming DWI Pretrial Diversion program proposed by the Harris County District Attorney's Office is going to benefit a great number of people. Despite all the benefits there are sure to be some negatives associated with the program. For instance, once the word gets out about the program DWI arrests will increase in the greater Houston area. Police agencies will arrest more people because they will know that the prosecutor will readily offer a Pretrial Diversion. Also, it has been a long held belief within the DWI task forces that the accused may "beat the rap, but will not "beat the ride." In other words, a person accused of a DWI will have to bear the expense of hiring a DWI attorney in order to properly defend a DWI case. Moreover, prosecutors will become less inclined to dismiss a DWI charge because they are going to push the pretrial diversion alternative. |

The first thing that anyone that has been arrested for theft or shoplifting needs to know is that these charges are considered to be crimes of moral turpitude.
Moral turpitude is a legal term of art with no generally accepted definition. In general, "crimes of moral turpitude" cover conduct involving dishonesty, These type of crimes can cause serious immigration consequences, impact professional licenses, or prevent employment. Thus, it is of utmost importance not to be convicted of a theft or shoplifting case. Almost daily I get a phone call from someone that decided to take the easier route of just paying fine instead of attempting to successfully complete a deferred adjudication. | Houston DWI Arrest Causes Wedding Night Blues |

Many of our clients are first time offenders and have typically never been in trouble with law enforcement prior to contacting us for help. When they arrive at our office the first thing they they normally tell us is how badly they were treated by the police. They also can not understand why the officer did not take into account their otherwise pristine criminal record. I often tell them about the different cases that we have defended where we have been amazed at the fact that an arrest had in fact taken place.
A perfect example of the police not making an exception for anyone is the recent DWI arrest of a groom on his wedding day. His case landed in Harris County Criminal Court Law #7 where Pam Derbyshire presides.
Luckily, every person that is charged with a DWI is presumed to be innocent and there are an infinite amount of ways a case may be defended. |

| Officer Do You Really Need to Arrest Me for that Marijuana Joint? |

Do you remember Jerry's girlfriend that was able to persuade anyone to get what she wanted? In fact, she was able to get out of traffic ticket by flirting with the police officer in the Seinfeld episode titled "The Calzone" despite Jerry admitting everything. Well not even a extraordinary persuasive person like that will able able to convince Houston, Texas area police officers to write them a citation for being in possession of a misdemeanor amount of marijuana despite the law allowing them the opportunity to do just that in the appropriate situation.
Last year the law changed where an officer has the option to arrest someone or simply write the person a citation for being in possession of less than four ounces of marijuana. In fact, Austin police officers hope to start the policy by the end of the year.
Since Houston, Harris County, Texas has a notorious overcrowding issue in their jails you would think they would embrace this law. " Not on my watch your not" said Former Harris County District Attorney Chuck Rosenthal bluntly...he notified all the police chiefs in Harris County that if their officers want to follow the new law and issue citations, the DA's office would not accept the charges. He flatly refused to recognize this law. Even several months after Chuck Rosenthal's resignation from the District Attorney's office the policy has not changed in Harris County.
Here is hoping that whoever becomes the new Harris County District Attorney recognizes this law and values the good it could do for the overcrowding issues that are occuring in the Harris, County Jail. |
